Just curious on your post. You mentioned your small batch...but supply 9 locations and sell bulk and wholesale? As a vendor at what point do you consider small batch?

Small batch is such a loosely used term now(a lot of the time for marketing,especially around here) I think anyone importing anything under a full air cargo container considers there self “small batch”. In my eyes as a fellow vendor I consider 250kg and shipments under small batch. With 20kg max per “strain”.

Why Texas? Seriously, is there a reason why all of my vendors are in Texas? Is Texas and kratom going to be like California and cannabis?

This part struck me as interesting.

Sec. 444.002. LABELING REQUIRED. (a) A kratom processor
shall label each kratom product with the product use directions
necessary to ensure safe and effective use of the product by a
consumer, including the recommended serving size for the product.
(b) A kratom retailer may not sell a kratom product that is
not properly labeled under this section.
Sec. 444.003. ADULTERATED, CONTAMINATED, AND PROHIBITED
PRODUCTS. A kratom processor or kratom retailer may not prepare,
distribute, sell, or offer to sell a kratom product that:
(1) is adulterated with a dangerous non-kratom
substance affecting the quality or strength of the product to a
degree that renders the product injurious to a consumer;
(2) is contaminated with a poisonous or otherwise
deleterious non-kratom substance, including any substance
designated as a controlled substance by Chapter 481 (Texas
Controlled Substances Act);
(3) has a level of 7-hydroxymitragynine in the
alkaloid fraction that is greater than two percent of the overall
alkaloid composition of the product; or
(4) contains any synthetic alkaloids, including
synthetic 7-hydroxymitragynine and synthetically derived compounds
from a kratom plant.

Maybe AKa is pushing Kratom Consumer Protection Act there? Basically same “rules” they proposed here in Oregon. Looks like Kate Brown doesn’t want to go the Kcpa route according to her last statement on it.

Thank you for posting that ... Texas KCPA bill - I'm working on, info about the similar KCPA Bill that just failed (again!) in Oregon.

The two bills are similar to Utah, EXCEPT - in Oregon they tried to setup a Big Government framework, the State Dept of Agriculture - All vendors would be required to Register with the Dept. and pay Fees - or face fines and criminal penalty. In other words... the Oregon Bill would have effectively banned sales of Kratom, outside of 1 vendor!!!

BUT "without" the State Dept framework - So many questions ?? How will the State of Texas TEST the kratom? How will the State of Texas know, which products are adulterated or not, or labeled correctly or not... without some State person enforcing the Law?

In other words - It's a ridiculous, un-necessary Law with NO method of enforcement. Laws with zero enforcement... are stupid. Thanks AKA!!!

Yep. AKA is pushing these "KCPA" bills, in many states. I checked Texas - This Senate bill 821, was sponsored by 1 Democrat (TX is controlled by Republicans), she did give the Bill a 1st Reading..... DEAD. Back in March, the TX Regular Session is over. So basically AKA, paid this State Senator to "read" the Bill - not 1 Republican signed on, nobody cared, the KCPA is totally dead in Texas.

In Texas, the Republicans are pushing bills regarding "Critical Race Theory" (oooh!! ) and "Abortion-inducing drugs" (Pennyroyal Tea ??) and... "Social Media Censorship" -- Kratom isn't even on their Radar. Not yet anyway.

Thanks for the question. Our definition of "small batch" is that we are a small importer of quality Kratom powder. We don't import large quantities of cheap Kratom that many companies do to manufacture extracts with and then they also sell their "cheap" Kratom powder that you'll find in smoke shops and gas stations typically. We do wholesale to those types of businesses but the Kratom products we supply them with are head and shoulders above what they are normally selling and this is one reason that we are having so much success in that arena. Once people try the products, they switch over to our brand because the quality is so much better than what they are used to and most of the time they are paying less. We saw a hole in the market with the cheap, overpriced, and adulterated Kratom products that are being sold and thought that we could offer a better product for a cheaper price and our strategy is working. So basically when we market our company as "small batch" that means that we have a higher standard of quality control and will not sell sub-par product at a premium price. Just to update, we are now at 11 stores and continuing to grow rapidly because of the quality of product we are putting out there on the market. We have all come across garbage Kratom on the retail market and that hurts the industry and leaves the customer feeling like they got ripped off and disappointed. That's a bad business model and unsustainable long-term. Delta Extracts Kratom is a small company but we are proud to offer premium quality products and our reputation is spreading because our customers are very happy with what their hard earned money is getting them when they purchase Kratom from us! There is a lot of truth in this statement. I suppose that "small batch" means different things to different people but for us, "small batch" means that we don't import large amounts of cheap Kratom. We only import and sell the best Kratom that we can source. We are a small company and we are building the brand off of the reputation of Premium Quality Kratom at the best price that we can offer combined with fast order processing and excellent customer service. We aren't just in it for the money as many vendors are but those companies come and go. Kratom has made a huge difference in my life personally and we want to pass this experience along to our customers. Even as we grow and start to import larger shipments, we will continue to market our brand as "small batch" because to us that term means only selling quality Kratom products.

Texas is leading the way in terms of regulations and setting a standard for quality control. There is a new bill that was passed by the Texas House of Representatives called the Kratom Consumer Protection act. They now require proper labeling and view Kratom as a food product meaning that it now falls under stricter standards than other states. This will result in more competition in the free market and competition is what makes vendors raise their standards to be successful in the industry and it also protects the consumer. I'm also from Texas and have never left so we operate out of this state. Texas also is very friendly to small business so it encourages people to move here and operate because of the way business is conducted in this state.

This is a correct statement. Although we do sell extracts, the same Kratom powder used to produce these extracts is the same powder that we sell. We don't import sub-par Kratom for any reason. We have found that when manufacturing extracts, we get a better quality final product when using quality Kratom and selling the same quality Kratom powder on the retail/wholesale market has proved to work for our business model. Everyone is tired of cheap bulk Kratom including us which is why we don't sell it. If you are buying products from Delta Extracts Kratom, you will be getting the best quality products for the best price whether it's our Kratom powder, capsules, or extracts.

Good point. There is still room for improvement overall in our industry but this is a good step in the right direction. There are actually civil penalties for vendors found to be in violation. Texas still does not require testing. The bill mainly addresses labeling because Texas now views Kratom as a food product meaning that those same requirements are now applied to Kratom products. We do have testing for all of our products even thought it is currently not a requirement by the state of Texas.

It's on the radar. The bill goes into effect on September 1st, 2021 and there are civil penalties for those found in violation. The bill was drafted by the Texas House of Representatives. IMO the bill will push Kratom products into the mainstream and breakdown the stigma associated with it. We don't always think regulation is the best thing for any industry. It all depends on what type of regulation is imposed but after reading the bill, we think that this is a positive thing.

I tend to agree with you that some of the time regulation can actually hurt industry for various reasons but having said that we think that how the bill was drafted is actually a good thing in this case. It is essentially making Kratom a food product in Texas with proper labeling and attempting to stop adulterated products from reaching the consumer market. Vendors found in violation can have civil penalties imposed upon them.

They're now in "Special Session" called by the Governor... all bills that were proposed during Regular Session, and did not succeed, are dead. The Bill that was quoted (above) went... nowhere? Yes, located in Central Texas. The bill number is HB-1097. Passed the vote in the house on April 30th. The bill was sponsored by a Republican and a Democrat. If you search HB-1097 Texas you will find results and can read the bill. It's a pretty straight forward bill that outlines the new regulations for vendors and says that civil penalities will be imposed for those found in violation. There is also a good article on another Kratom site that can be found if you search Texas Kratom Consumer Protection Act. Hope this helps!

Thanks for the big ups! We've been doing well for being a small business! It's hasn't been easy but then again, I think most things worth having take hard work. We have 11 retail shops carrying our products that we wholesale to currently plus our website for online retail customers. Trying our best to provide the best service/product that we can. OK thanks... First, the 87th Texas Legislative Session: is OVER - So that House Bill HB-1097 is... dead. . Here's a LINK for anyone interested: Texas KCPA

On that Page, see Tabs across the top: History/ Text/ Actions/ ...Bill Stages. Under Bill Stages, we see what happened. Yes the House Bill did pass on April 30. But the companion Senate Bill 821, got through Committee, but never had a Senate vote. So there was never a Final Bill, never got to Governor's Desk, never signed into Law, and the KCPA is.... DEAD until next year maybe.

There are SO many problems with this "KCPA", it's really a waste of time - that does nothing except Ban sales to under Age 18. Otherwise... it's a silly "Regulation" with no means of enforcement. You'd think Republicans would be totally AGAINST this type of BS "Big Government" Regulation that does nothing ??

I guess we could start with ... Who would decide what's "adulterated" or not ?? . Is the State of Texas, setting up a Regulatory framework to TEST every single batch, for alkaloid content ?? NO. Then... Why have a Law, when there's no way of checking whether the Law is followed, or not. Similar to alcohol, or legal Cannabis. States have setup a big framework to TEST, those things... You can't just make backyard moonshine and, sell your booze in stores. Weed is tested for THC content. Oh wait, that costs MONEY ?? Oh yeah. States spend a ton of Money, setting up labs to verify the alcohol content and THC content.

That's what just happened in Oregon. They DID attempt, to setup a big Government agency to TEST kratom alkaloids , and force all vendors to Register with the State Dept Agriculture and pay huge FEES... with laws punishing any small vendor who didn't pay a big FEE, to Oregon. That would have effectively banned, Kratom sales except for the 1 shitty local vendor who was pushing the KCPA Law.

There does seem to be some confusion about this issue and if I am mistaken I appologize. I do see that it hasn't passed the senate yet but the bill states that it will go into effect September 1st, 2021. Maybe it's a dead bill like ballzdeep said? Not totally sure TBH after checking the link that was posted. I was going off of what the bill stated about it going into effect. Either way, we still test all of our Kratom and do not adulterate any of our products so whether it passes or not, we have already been doing what was in this bill with exception of labeling and serving size. Our product is labeled as Mitragyna Speciosa with the amount of the product similar to how most other vendors label their products. But the companion Senate Bill 821, got through Committee, but never had a Senate vote. So there was never a Final Bill, never got to Governor's Desk, never signed into Law, and the KCPA is.... DEAD until next year maybe.

There are SO many problems with this "KCPA", it's really a waste of time - that does nothing except Ban sales to under Age 18. Otherwise... it's a silly "Regulation" with no means of enforcement. You'd think Republicans would be totally AGAINST this type of BS "Big Government" Regulation that does nothing ??

I guess we could start with ... Who would decide what's "adulterated" or not ?? . Is the State of Texas, setting up a Regulatory framework to TEST every single batch, for alkaloid content ?? NO. Then... Why have a Law, when there's no way of checking whether the Law is followed, or not. Similar to alcohol, or legal Cannabis. States have setup a big framework to TEST, those things... You can't just make backyard moonshine and, sell your booze in stores. Weed is tested for THC content. Oh wait, that costs MONEY ?? Oh yeah. States spend a ton of Money, setting up labs to verify the alcohol content and THC content.

That's what just happened in Oregon. They DID attempt, to setup a big Government agency to TEST kratom alkaloids , and force all vendors to Register with the State Dept Agriculture and pay huge FEES... with laws punishing any small vendor who didn't pay a big FEE, to Oregon. That would have effectively banned, Kratom sales except for the 1 shitty local vendor who was pushing the KCPA Law.

I followed the link you posted and see that it stopped at the senate. I appologize for any confusion that I may have caused because I was reading directly off of the bill where it stated that it goes into effect on September 1st, 2021. Regulation can be a double edged sword. I tend to agree with you that Government should stay out of people's business especially when it comes to adults and substances. I can also see the point you made about a money grab. We'll keep following this and I hope that any regulation that does come into effect will essentially just create an enviornment for companies to have higher standards that will protect the end consumer. The company that I work for tests all of the Kratom that is sold regardless of the absence of law and we do our best to only put out quality products on the market. Thanks for the responses!

How do you substitute extract for powder so that the extract is equivalent to a dose of basic powdered leaf? In other words, if I take 6 grams of powdered green, what amount in grams would I take in extract? There are all these dire warnings about extract ruining tolerance, but if you only take an equivalent dose of extract, that shouldn’t matter, right?

I was just thinking that for traveling purposes it would be much easier to travel with capsules and since most of the capsules I’ve seen have at most 500 mg, that would be 12 capsules, which is bulky to carry and kind of annoying to consume.

Hello and thanks for your question! Not all extracts are created equal so it depends on what the Mitragynine content of the particular Kratom Extract is to properly measure your dose. Most quality Kratom powder contains approx. 1.3-1.8% Mitragynine per gram of powder. Assuming your particular Kratom powder contains 1.5% Mitragynine per gram as an example, this would equal 15mg of Mitragynine per gram. You are correct that most capsules can hold 500-600mg of powder so (2) of those capsules would equal 1 gram of powder or 15mg of Mitragynine. So using that formula, if you are taking (6) grams of powder or (12) 1/2 gram capsules that would equal 90mg of Mitragynine. So now that we understand how that part works, we need to determine what amount of extract would roughly equal your normal 90mg of Mitragynine dose. This can be confusing because a lot of companies sell extracts with labels such as 20x or 50x etc. We don't think this is a very accurate way of determining actual Mitragynine content so our company acutally lists the Mitragynine content on our product labels based on our lab reports. This way, the customer knows exactly how much Mitragynine is in each product or serving size. We sell (4) types of Kratom Extract products. I will list them here along with their Mitragynine content:

Liquid Kratom Extract Shot (10ml of Liquid) = 110mg of Mitragynine per bottle *Each bottle says 1-2 servings because a full bottle serving might be a bit strong for a person new to Kratom. In your situation, a full bottle would get you close to your normal dose. It would actually contain 20mg more that what you are used to so it would be a little stronger than the 12 caps that you are currently taking assuming that your Kratom Capusles contain 1.5% Mitraynine per gram.

Enhanced Kratom Powder = 110mg of Mitragynine per gram of powder *0.8 grams of powder would equal your current dose of 12 capsules

Enhanced Maeng Da Capsules = 45mg of Mitragynine per capsule/(5) capsules per Jar *Taking (2) of these capsules would be equal to your current dose of 12 capsules

Super Enhanced Maeng Da Capsules = 115mg of Mitragynine per capsule/(5) capsules per jar *Taking (1) of these capsules would be a little stronger than your 12 capsule dose similar to the Liquid Kratom Extract Shot. One of these capsules would contain an extra 25mg of Mitragynine than your 12 capsule dose

Something to condsider is that you could use our Enhanced Kratom Powder and make your own capsules. Just measure out your dose and cap them up yourself. A small capsule maker can be bought for around $20. The good thing about our Extracts is that you don't have to take near as much because they are so potent. So around 0.8 to 1.0 grams is all that would be needed in your situation which is a very small amount. This product can also be mixed with regular Kratom powder to make your batch stonger or can be taken by itself.

In regards to your statement about tolerance, I tend to agree with you. Your body does not really know if it's taking extract or regular Kratom. It just knows that it's getting 90mg of Mitragynine. The problem with Extracts starts to appear when people begin to increase their dose to the point where they have to take large amounts of regular Kratom powder to get the same effect as before. So if you keep your dose the same, you should not run into this problem. Also, all of our Extracts are Full-Spectrum meaning that they contain all of the alkaloids that are natually found in the Kratom Leaf. We do not use isolated Mitragynine Alkaloid for any of our Extract Products because we have found that the effect is better with all of the alkaloids just like it's found in nature.
