How are some of the US sellers getting around the "not for human consumption" labeling ?
Is it legal for human consumption in the US or not ?

What do you mean "getting around it"? They put it on their packages and that's all they have to do - it eliminates their having to deal with FDA and other such entities.
The fact that WE all know it's BS doesn't mean anything - I don't know anyone who is put off by that label (it would be a different matter if it were retail - then someone in a store might pick up a package and go "Whoa!" But online folks already KNOW what they are getting).

Well yes all of us online know this like you said.
What I was thinking of the are little shots of extract that look like a 4 hr energy drink. That's obviously and undeniably marketed for human consumption
There have been raids on US suppliers and kratom seized and assets confiscated until those arrested can prove their innocence without access to their resources .
Kratom was sold on every other corner when I was in South Florida . Kratom and delta 8

I don't know how "obvious" something is - those Tide pods "obviously" look like little candies.
And as for raiding - they don't raid because of any "human consumption" thing - they just want to get rid of our favorite leaf.
I imagine most of the sellers just do what most do - put the label on and don't worry about it.

Let me try to solve your confusion ... Kratom is Not Approved by the FDA, as a "Dietary Supplement" - Or for any other purpose. "Food" etc.
Start there.... In that Case - The Most Legal way, to SELL kratom IS - Not For Human Consumption. aka NFHC. The great majority of Online Vendors, sell kratom NFHC.
Kratom is NOT and has never been, a "drug"... OR a "Controlled Substance" in the USA... But, as you mention - The Problem is, Retail stores - are advertising, packaging, and selling... FOR Human Consumption. Obviously! SO... They are selling AS an UNAPPROVED "Dietary Supplement" and - they use a Supplement Facts Label - again, Kratom is NOT illegal. America is a Free Market - you can SELL, leaves of a plant, in a bag here - you don't need "permission" to sell a legal Product... Sell little bags full of dirt ? Perfectly fine here.
ALL of the large vendors RAIDED - have been marketing, packaging, selling - Caps and "Retail Products" FOR Human Consumption... there has never been, 1 single Online Vendor, charged or busted in ANY way - for selling NFHC - it's vendors who make "Medical Claims" on their website, who have run into trouble.... Notice, TOP vendors on the Vendor List - have very PLAIN websites, there is no comment, NO discussion of using kratom for ANY "purpose". And most vendors DO NOT participate on any Forum like MM - for that reason.

When you go to a website and see the words pain relief ANYWHERE on the website you should run away. That business owner doesnt care if hes putting himself out there for trouble, or he doesnt know, which is equally bad business.
If you claim kratom provides pain relief you can not only get shutdown by the FDA but sued and lose everything. The fda has not approved Kratom for anything, much less pain relief.So all it would take is a customer buying your product that your advertising or representing in any way to provide pain relief to sue you. They would just claim they bought the product because it said it would provide pain relief and my situation has gotten worse because of it. You will loss the case because your product isnt approved for anything and the judge will allow you to pay as much as the person is requesting.
Its like a 100% guaranteed pay day for anyone out there. Just dangling right there 100k easy, 1million maybe?
