New Oregon Heavy Metals Law :/

Post by MitSpec7 »

Hey everyone! :D
I'm wondering how far the news has traveled about Oregon's new heavy metals law that brought the allowable levels to a lower amount than baby food. Are any other states setting up for this? Would we know? I guess Oregon very quietly passed this in the summer of 2023 without letting vendors know or allowing them any time to petition or fight it. This seems like a huge deal that could sweep us all without warning. I'm curious what everyone thinks about this. Thank you for your kind input.

Won't have any effect. No states (at least none I know) classify kratom as "fit for human consumption". So doesn't really matter how careful they want our foods to be.

I had just got into HERB Research got my login and everything. Then I got an email and they said they can't sell to me because I live in Oregon. I hope that other vendors dont follow suit. This is the email:

"Hello Erik

Soooo Oregon recently passed a law making the heavy metal levels in
Mitragyna Speciosa less than they allow in baby food. Only 30% of the
product coming into the Country tests below those levels.

Unfortunately we will be discontinuing the sales in Oregon until the
good people of this beautiful State decide to make that change. We are
very sad to have t make this decision. Please keep an eye on this law to
change and once it does we would be ecstatic to welcome you to the team.
Thank you for your understanding. We send this with a heavy heart as we
are an Oregon company and as family style as we like to be these laws
are in place.

Thank you so much for reaching out."

Have no idea why they would say/do that - they can't sell for human consumption anyway (then again Oregon is just plain weird - I suspect if they weren't based there there would be no issue).

I'm moving across the colombia to washington anyways so I'm not worried all to much. Hopefully someone else has a better understanding of it.

wow. Well, if it is legal to arrange a shipment to oregon through this site, maybe you could find someone who can serve as a midpoint in the route?

(i love herb research, so would love to see you get some if possible)

Most kratom businesses would have a hard time in court arguing against kratom being used for consumption. Very hard, like so bad you would be laughed at by the court and of your peers. Im not aware of any lawsuits in the past few years where the defense(kratom company) tried to use that defense as it wont work.

I just saw the limit is .5ppm. Its not crazy but its not reasonable. Just for reference any anything over 0.6ppm (kratom included) sold in California has to have that warning "this is known to the state of California to cause cancer and birth defects" label which i have never seen on a kratom package.
